Trial Practice

Campbell, Latiolais & Averbach, LLC takes pride in the fact that its members are recognized experts in trial practice. Colin Campbell has served as a founder, organizer and faculty member of the Colorado Defense Lawyers Association Trial Academy, and Clifton Latiolais has served on the faculty at advocacy seminars sponsored by the National Institute for Trial Advocacy. Both are members of the prestigious American Board of Trial Advocates, and maintain AV Preeminent peer review ratings with Martindale-Hubbell. Robyn Averbach, also an AV Preeminent rated attorney by Martindale Hubbell, and Rebecca Wagner, have been selected by Colorado Super Lawyers for the last three and four years, respectively, as "Rising Stars" – an honor bestowed only upon the top 2.5 percent of lawyers in this jurisdiction. As a member of the Continuing Legal Education Committee for the Colorado Defense Lawyers Association, Ms. Averbach oversees the accreditation of legal education seminars for Colorado attorneys. Ms. Wagner, as part of her litigation practice, regularly conducts seminars for clients in the areas of insurance bad faith and catastrophic injury litigation. David Murphy has taught numerous legal education seminars on personal injury and construction litigation, and has litigated a number of aviation cases for both domestic and international clients. The attorneys have litigated in excess of 200 jury and bench trials involving general liability defense, bad faith, construction litigation and many other areas of law. Joleen Mossoni Polk, although relatively new to the practice of law, is an accomplished appellate advocate, gaining valuable experience as a member of the University of Wyoming Moot Court and Trial Practice teams, and as a participant in the Defender Aid Program, arguing cases before the United States District Court for the District of Wyoming and the United States Court of Appeals for the Tenth Circuit.

The Firm has been asked to prepare amicus briefs on behalf of the Defense bar and insurers on numerous appellate issues, including the “Four Corners” doctrine as it relates to coverage and the Colorado Consumer Protection Act, and has been actively involved in the Colorado Defense Lawyers Association’s various activities and presentations.
